K. METZLER CALLED A REGULARLY SCHEDULED MEETING OF THE INLAND WETLANDS AND WATERCOURSES COMMISSION TO ORDER AT 7:32 P.M. NOVEMBER 26, 2001 AT THE TOWN OFFICE BUILDING, 40 OLD FARMS ROAD, WILLINGTON.

NEW BUSINESS:
None.
OLD BUSINESS:
1. Bond release for Loshe Road gravel operation, Estate of Joseph Mihaliak
G. Jones said the commission previously requested that he check the area for erosion and runoff. There is a little runoff but it is not a significant amount. There was no sedimentation running and there appears to be no erosion.
G. Blessing said he had previously seen a lot of sedimentation running during storm events.
G. Jones said he checked it after the last rain and the water was clear.
K. Metzler asked if the area had vegetated.
G. Jones said Yes.
G. BLESSING MOVED TO RELEASE THE BOND FOR THE LOHSE ROAD GRAVEL OPERATION.

2. File #W2001-56-Application for forest products harvest on property south of Spak Road and west of Lohse Road. Estate of Anna Kovacik, owner/Anthony J. Grossi Forest Products, applicant. (Received on 10/17/01).
Joe Vobril spoke on behalf of the applicants.
J. Vobril said he & Gary went and viewed the property. He submitted a sketch and noted the crossing had been eliminated. The operation is plenty of distance from the brook. He reviewed the map.
G. Jones said the wetlands are visible by the Mountain Laurel area. There are more wetlands present than were originally submitted, according to the soils maps.
G. Blessing asked about the boundary lines.
G. Jones reviewed the plans and said they are about 100 feet from where they are logging.
J. Vobril said there is a wire fence in that area.
G. Blessing asked about homes on the upper boundary.
G. Jones said they are not adjacent to the property.
J. Vobril said there are orange flags by the property line. The “gut” is about 50 feet wide. There is an existing trail that runs through there from the last harvest.
K. Metzler asked if there was any activity in the wetlands.
G. Jones said there are a few trees on the edge, but there is really no activity in the wetlands.
F. Dirrigl asked about the stream buffers.
J. Vobril showed the info on the map.
G. Jones said the trees in the buffer area are pretty spread out.
F. Dirrigl asked for clarification if the applicants were proposing buffers or not.
J. Vobril said there is a running brook, and that is why the buffer is mentioned. It is down in the hollow at the bottom of the bank, and the trees are at the top. They are 50 feet from the stream for sure.
D. Schreiber asked if this was a clean-out harvest.
J. Vobril said it is about 100,000 board feet. There is nothing in the wetlands that is harvestable.
D. Schreiber asked if there would be trees left behind.
J. Vobril said yes. There is no money in taking trees that are less than 15 or 16 inches.
F. Dirrigl asked if there was any evidence of a vernal pool.
G. Jones said he did not see any.
G. Blessing said since the crossing is not there, a ruling of No Jurisdiction may apply. There is activity within 50 feet, but not within the wetlands.
G. BLESSING MOVED THAT THE COMMISSION HAD NO JURISDICTION FOR FILE #W2001-56.

STAFF REPORT & DISCUSSION:
The commission discussed information from the sitewalk for File #W2001-56.
G. Jones noted the office has received a new application for a 5900 square-foot house at Miller Farms. The applicants may need to come back to the commission for changes from the original plan.
